Hours of Operation

Business hours are 9am - 5pm Mon-Friday. Excludes Public Holidays.


If you require non essential help with your site after the posted hours (unrelated to continued service operation), such as on weekends or holidays, you will be charged an extra $75 per support incident.

Quotes

Quotes provided to prospects will be honoured for 30 days. A new quote will then be provided upon request.


Discount coupons provided with quotes are time limited and must be used within the quoted period of receiving the coupon.

We like to reward clients that take action to improve their online presence.

Payments, Charges & Fees

All Sitebuilder web design projects require the setup a monthly subscription for the website to go live. Free a preview design will be given before this stage for reference in my free demo.


A Sitebuilder Subscription will be required to set a website live, email hosting and domain purchase or transfer is also only setup after a subscription is started.


Updating the theme requires a client to be on the latest version of Sitebuilder, a free theme redesign will be optionally included every 12 months as part of your subscription. Additional theme redesigns outside of the included in a plan are $899 each with included design preview provided upfront.


Extra Domain Renewals (if not included in the subscription) will be charged automatically upon expiry if you hold an existing Sitebuilder subscription, it is always assumed you wish to have your website and service remain uninterrupted unless I am otherwise told to cancel the service, clients will be contacted when domains are due via email and sms as a backup.


I use MoonClerk and Stripe to process card transactions.


Your connection is encrypted with 128-bit encryption. The connection uses TLS 1.2. The connection is encrypted and authenticated using AES_128_GCM and uses ECDHE_RSA as the key exchange mechanism.


The identity of this website has been verified by DigiCert SHA2 High Assurance Server CA.


MoonClerk and Stripe provide full SSL encryption and all PCI compliance. All card numbers are fully encrypted on disk with AES-256.


PCI compliance is certified to PCI Service Provider Level 1, the most stringent level of certification available. All browsers interact with MoonClerk and Stripe over HTTPS.


Outstanding Payments

Monthly Subscriptions

If no subscription payment has been received 14 days after a monthly payment is due the website will be suspended until payment is made.

If no subscription payment has been received 30 days after a monthly payment is due the website and email hosting will be suspended until payment is made.


Yearly Subscriptions


If no subscription payment has been received 30 days after a yearly payment is due the website and email hosting will be suspended or cancelled until payment is made.


Payment Extensions


You can let me know if you need an extension and I can work something out for you, however to qualify for an extension please be in communication before the suspension time frames.


Automatic Cancelation


If you have not been in contact or have not asked for an extension and no payment has been made your subscription will cancelled at 60 days and will not be resumed until payment is restarted.

Copyright & Ownership

Websites Built in Sitebuilder cannot be transferred to other hosting services, by paying for Sitebuilder you are paying for the platform and for unlimited hosting to go with it, we can however integrate the site into existing email services or 3rd party email services seamlessly.

You may not under any circumstances use a Free Preview Design to construct your own site or instruct another designer to take this template for use with your project with them. Jon Web Design will legally follow up any person or company that steals its design property.


Jon Web Design reserves the right to resell custom designed web sites that remain unpaid by the original client, unaccepted mockups or other graphics created by Jon Web Design but not in legal use by the client.


Jon Web Design reserves the right to display websites and graphics that have been designed on its clients websites for the portfolio, and in any marketing material to aid as examples of my work.

Refunds & Chargebacks

My Payment policies are clearly stated below, and all clients are asked to read and tick I agree to my terms of service prior to the start of any subscription.


Refunds

I offer a 90 day 100% money back guarantee, if you are not happy with my service at any point you can request a full refund of funds paid in the last 90 days.

I am so confident with the service and support that I know you will be happy with the product.

Refunds are not made to client's who simply do not need their website, email and domains any more, if you need to just cancel your website and subscription see Cancellations below.


If you are claiming a refund please note that your website and subscription will be suspended Immediately and cannot be transferred to any other hosting company, any email accounts associated with the subscription will be shutdown within 30 days to give you a chance backup or setup an email only subscription, any domains in your have registered to Jon Web Design will no longer be automatically renewed, you will receive notifications when they are due for renewal and can choose to transfer them to another registrar or renew them with Jon Web Design.


​If you would like to resume the service at any stage you will need to just setup your subscription again, your website will be unsuspended and any email accounts recreated (minus any emails stored previously if 30 days have passed).


Chargebacks

​Jon Web Design will not negotiate chargebacks with any person or company. If funds have been charged back an invoice will be sent with the missing funds and you service will be suspended until the repayment is made.

Cancellations

If you wish to cancel your Sitebuilder Website and subscription if its no longer needed please book in a call or send a request to support@jonwebdesign.com.au from the account holders email (the email used to sign up for the subscription, we cannot accept cancellation requests from other email accounts due to security reasons), please be aware this will need to be done before the the first of the next month to negate receiving another monthly bill. If your request was received before the new month but not processed until the next I will refund the extra payment.


Please note that your website and subscription will be suspended at the end of the current month and cannot be transferred to any other hosting company, any email accounts associated with the subscription will be shutdown within 30 days to give you a chance backup or setup an email only subscription. 


You will be given 30 days access to the editor with your existing accounts to recover any for your image/video materials and text content from the editor unless otherwise negotiated for more time, during this time you will not be able to publish the website.


Domain name purchases and renewals are final and cannot be refunded once paid, any domains in you have registered with Jon Web Design will no longer be automatically renewed if they were part of a subscription, you will receive notifications when they are due for renewal and can choose to transfer them to another registrar or renew them with Jon Web Design. Free Redirection and Email Forwarding are also available if required.

Development & Delivery

Jon Web Design understands the importance of completing projects in a timely manner.


The client agrees to provide all text, graphic content and other requested materials to complete the project within 30 days of the subscription starting unless otherwise negotiated, the client is responsible for the timely delivery of all information required.


Jon Web Design agrees to complete the web design project within a maximum 60 days from the day all information is provided unless otherwise negotiated, otherwise a refund of the months unused will be provided. 


If we are unable to communicate with a client on a project for a duration of at least 60 days by phone or email during the design and development process, the project will be cancelled and subscription suspended.


Liability

Services purchased from Jon Web Design are provided "as is" without warranty of any kind that the web design project will be uninterrupted or error free. In no event shall Jon Web Design be liable to the client for any direct, indirect, special, punitive, incidental, or consequential damages arising out of the use of the website, hosting & domain services, and/or goods provided to the client. This includes, without limitation, lost profits, business interruption, loss of data or other losses directly resulting from the use of the website, hosting & domain services and/or goods provided to the client. Jon Web Design will do everything possible to prevent loss or damage, however the entire risk as to the quality and performance of the web design is with the client.

Project Consideration

Please note that Jon Web Design will not accept projects that are found to be morally questionable, unethical, or distasteful. 

This is non-negotiable.

Acceptance

By starting a subscription for my services you are agreeing to all of the terms of service as written here along with our Privacy Policy.

 

Jon Web Design reserves the right to change or update these terms at any time without prior notice.
